DISCLOSURES & TERMS OF USE

1. Nature of Service

MIRACLEBOT-1G is a software tool. It provides algorithmic market scanning, pattern detection, signal generation, and optional autonomous order routing via broker APIs using credentials YOU supply.

MIRACLEBOT-1G is NOT:

• A registered investment adviser, broker-dealer, commodity trading adviser (CTA), commodity pool operator (CPO), or introducing broker
• A member of FINRA, the NFA, the SEC, the CFTC, or any self-regulatory organization
• A bank, custodian, clearing firm, or fiduciary
• A signal service, trade-copying service, or managed account program

MIRACLEBOT-1G does NOT hold, custody, or control user funds at any time. All funds remain in the user's own brokerage account under the user's sole ownership and control. MIRACLEBOT-1G executes orders only when the user has explicitly configured autonomous execution and supplied their own broker API credentials.

2. No Investment Advice

Nothing displayed, generated, or transmitted by MIRACLEBOT-1G — including but not limited to scanner signals, strategy outputs, analytics, dashboards, documentation, marketing materials, or support communications — constitutes investment advice, financial advice, trading advice, legal advice, tax advice, or a recommendation to buy, sell, or hold any security, derivative, cryptocurrency, or other financial instrument.

All content is provided for informational and analytical purposes only. MIRACLEBOT-1G does not:

• Make personalized investment recommendations
• Assess your financial situation, risk tolerance, or suitability for any investment
• Opine on whether any asset is appropriate for you
• Guarantee accuracy, completeness, or timeliness of market data

If you require investment advice tailored to your individual circumstances, you should consult a qualified, licensed investment adviser in your jurisdiction.

3. User Responsibility

You, the user, are SOLELY responsible for all trading decisions and outcomes. MIRACLEBOT-1G operates according to the configuration and credentials you provide. You acknowledge and agree that:

• You have sole discretion over whether to enable autonomous execution
• You have sole discretion over risk parameters including position sizing, stop-loss levels, daily loss limits, and maximum concurrent positions
• You are responsible for monitoring your account and can pause or halt the bot at any time via the dashboard kill switch
• You are responsible for understanding the strategies, signals, and automated behaviors before enabling live execution
• You are responsible for the security of your own broker API credentials
• You are responsible for ensuring your use of MIRACLEBOT-1G complies with the terms of service of your broker, your jurisdiction's securities laws, and all applicable regulations

MIRACLEBOT-1G provides tools; YOU operate them. YOUR decisions, YOUR capital, YOUR risk, YOUR responsibility.

4. Market & Trading Risk

Trading financial instruments carries substantial risk. These risks include but are not limited to:

• Total loss of capital — you may lose your entire deposit, and with margin accounts, more than your deposit
• Market risk — prices can move sharply against positions with no warning, including gap moves outside of trading hours
• Liquidity risk — orders may not fill at expected prices, especially in small-cap, after-hours, or low-volume markets
• Execution risk — slippage, partial fills, and failed orders can cause results to differ materially from strategy signals
• System risk — software bugs, internet outages, broker API failures, exchange halts, or regulatory actions can interfere with execution and result in losses
• Pattern Day Trader (PDT) rules — U.S. accounts under $25,000 equity are subject to day-trading restrictions which can prevent closing positions when desired
• Leverage & margin — trading on margin amplifies both gains and losses and can result in liabilities exceeding the account balance
• Volatility risk — periods of extreme market volatility can cause abnormal fills, wider spreads, or execution failures

Small-cap and momentum strategies in particular carry elevated volatility and execution risk. You should not commit capital you cannot afford to lose.

5. Past Performance

Past performance is not indicative of future results. Any historical results, backtest outputs, paper-trading simulations, analytics dashboards, per-strategy statistics, win-rates, or hypothetical returns displayed by MIRACLEBOT-1G are NOT guarantees of future performance.

Hypothetical and simulated performance has known limitations:

• It is prepared with the benefit of hindsight
• It does not involve real financial risk or emotional factors
• It may not reflect actual slippage, partial fills, or liquidity constraints
• It may not reflect the actual execution costs encountered in live trading

Transaction Cost Analysis, slippage measurements, and per-strategy attribution provided by MIRACLEBOT-1G are estimates based on user trading history and market data; they are provided for informational purposes only and should not be relied upon as precise or audited figures.

6. Broker Relationship

MIRACLEBOT-1G is independent of any broker or exchange. To use the platform's autonomous execution features, you must maintain your own active account with a supported broker and supply your own API credentials to MIRACLEBOT-1G.

You acknowledge that:

• Your broker relationship is directly between you and your broker — MIRACLEBOT-1G is not a party to that relationship
• You are subject to your broker's terms of service, commission schedule, margin policies, and applicable regulations
• MIRACLEBOT-1G does not receive compensation from any broker in connection with your trading
• Broker-side issues (outages, rate limits, order rejections, account restrictions) are outside the control of MIRACLEBOT-1G
• You are responsible for securing your API credentials and can revoke them at any time through your broker

MIRACLEBOT-1G is not affiliated with, endorsed by, or sponsored by any broker, exchange, market maker, clearing firm, or regulator.

7. Software & Data Warranty

MIRACLEBOT-1G is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the software will be uninterrupted, timely, secure, or error-free
• Warranties that defects will be corrected or that the service will meet your requirements
• Warranties regarding the accuracy, reliability, or completeness of any market data, scanner output, or analytics

Market data is sourced from third parties and may contain errors, omissions, or delays. Scanner signals, pattern detections, and strategy outputs are algorithmic estimates — not guarantees. Software may contain bugs, and automated systems can fail. You accept the risk that the software may not behave as expected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MIRACLEBOT-1G, its operators, owners, employees, contractors, suppliers, and affiliates shall NOT be liable for:

• Any direct, indirect, incidental, consequential, special, exemplary, or punitive damages
• Loss of profits, trading losses, loss of data, loss of goodwill, or business interruption
• Damages resulting from software bugs, broker outages, data delays, network failures, or scanner errors
• Damages arising from your use or inability to use the platform

This limitation applies whether the claim is based on contract, tort, strict liability, or any other legal theory, even if MIRACLEBOT-1G has been advised of the possibility of such damages. In no event shall MIRACLEBOT-1G's total cumulative liability to you exceed the fees you paid to MIRACLEBOT-1G in the twelve (12) months preceding the claim.

9. No Fiduciary Duty

MIRACLEBOT-1G does NOT owe you a fiduciary duty. MIRACLEBOT-1G is a software vendor, not an adviser, agent, or trustee. There is no duty of loyalty, duty of care, duty of good faith, or duty to act in your best interest in the fiduciary sense. Any suggestions, defaults, or recommended configurations presented by the platform are generic and not tailored to your circumstances.

10. Tax & Legal Compliance

You are solely responsible for:

• Reporting and paying any taxes (including capital gains, wash-sale adjustments, and income) arising from trading activity conducted through MIRACLEBOT-1G
• Complying with all securities, commodities, banking, tax, and other laws applicable in your jurisdiction
• Obtaining any required licenses, registrations, or approvals to trade the instruments and strategies available through MIRACLEBOT-1G
• Determining whether autonomous algorithmic trading is permitted under your broker's terms of service (some brokers and funded accounts prohibit bots)

MIRACLEBOT-1G does not provide tax advice, tax forms, or tax reporting services. You should consult a qualified tax professional regarding your trading activity.

11. Third-Party Services

MIRACLEBOT-1G integrates with third-party services (brokers, payment processors, market data providers, email providers, hosting platforms). Use of those services is governed by their respective terms. MIRACLEBOT-1G is not responsible for the performance, availability, policies, data practices, or pricing of any third-party service. Interruption or change of any third-party service may affect MIRACLEBOT-1G functionality.

12. Intellectual Property

All software, algorithms, scanner logic, strategy parameters, dashboard interfaces, documentation, and content provided by MIRACLEBOT-1G are the intellectual property of MIRACLEBOT-1G and its licensors. Your subscription grants you a limited, revocable, non-exclusive, non-transferable license to use the service for personal trading. You may not reverse-engineer, redistribute, resell, or commercially exploit the software or its outputs without prior written permission.

13. Service Changes & Termination

MIRACLEBOT-1G reserves the right to modify, suspend, or discontinue any feature, strategy, or aspect of the service at any time, with or without notice. Subscriptions may be cancelled by either party. Access to the platform ends when a subscription lapses or is revoked. Open positions held at the time of termination remain under the user's sole control at the user's broker; MIRACLEBOT-1G has no obligation to close, monitor, or manage those positions after access ends.

14. Privacy & Data

MIRACLEBOT-1G stores user email, subscription status, broker API credentials (encrypted), risk configuration, and trading activity metadata necessary to operate the platform. Broker credentials are used only to execute orders and fetch account state; they are never shared or sold. Trading activity may be logged for audit, compliance, and debugging purposes. Users may request deletion of their account and associated data by contacting support; some records may be retained as required by applicable law.

15. Governing Law & Dispute Resolution

These disclosures and your use of MIRACLEBOT-1G are governed by the laws of the jurisdiction where MIRACLEBOT-1G is registered, without regard to conflict-of-laws principles. Any dispute shall be resolved through binding individual arbitration rather than class action, to the maximum extent permitted by law. You expressly waive any right to participate in a class action against MIRACLEBOT-1G.

16. Acknowledgment

By creating an account, subscribing to, or using MIRACLEBOT-1G in any capacity, you acknowledge that you have read, understood, and agree to be bound by these disclosures and terms in their entirety. If you do not agree, you must not use the platform.

MIRACLEBOT-1G is a tool. You operate it. You accept all risk. MIRACLEBOT-1G does not advise, does not trade for you, and does not guarantee outcomes.
